Decision and Payments

The Fund issues a decision on the granted right to substitute child support within two months of receiving a complete application, in accordance with the General Administrative Procedure Act.

Based on the final decision (either after 15 days from receipt if no appeal is filed, or after receiving the decision of the Ministry in case of an appeal), the Fund will make the first payment of substitute child support by the 15th of the following month. All subsequent payments will be made for the current month.

Substitute child support is paid to all eligible beneficiaries once a month, specifically on the 15th of each month. If the 15th falls on a Saturday, Sunday, or public holiday, payment will be made on the last working day before that.

An appeal against the decision is allowed. The appeal period is 15 days from the receipt of the decision. Appeals should be addressed to the Ministry of Labour, Family, Social Affairs and Equal Opportunities, but sent to the Public Scholarship, Development, Disability and Maintenance Fund of the Republic of Slovenia, Dunajska cesta 20, Ljubljana. According to the General Administrative Procedure Act, the appeal may also be submitted orally for the record at the Fund’s premises. The Ministry must decide on the appeal within two months from the date it was filed. In legal disputes against the Ministry’s decision, the Administrative Court of the Republic of Slovenia is the competent authority.

An appeal submitted by the maintenance debtor who participated in the procedure does not suspend the enforcement of the decision.

The amount of substitute child support is adjusted in accordance with the child support and substitute support adjustment coefficient, and depends on the age of the child.

The age condition is considered fulfilled in the month the child reaches the specified age. The child becomes entitled to substitute child support from the first day of the month following the submission of the application, in accordance with the law.

As of 1 February 2025, the monthly amounts are: 95,51 EUR for a child under the age of 6, 105,05 EUR for a child aged 6 to 14, 124,14 EUR for a child over the age of 14. If the court-ordered child support is lower than these amounts, the substitute payment equals the actual court-determined amount.
