Procedure for Claiming the Right

The request to claim the right to substitute child support must be submitted by the child’s legal representative, or by the entitled person themselves once they reach the age of 18.

The request must be submitted using the prescribed application form, which is available in Slovenian only.

The following documents must be attached to the application:

  • The legal document determining the child’s maintenance (court judgment, court order, etc.);
  • A notice from the competent social work center on the latest adjustment of the maintenance amount;
  • If enforcement was previously attempted: proof that the entitled person or legal representative sought enforcement of the maintenance (e.g., a motion for enforcement, a court order on enforcement, or a statement that a complete request for cross-border maintenance recovery has been submitted; in this case, the Fund will verify the date of submission). The documentation must show that the enforcement procedure has been ongoing for at least two months or was unsuccessful due to reasons not attributable to the claimant.
    (Prior enforcement is no longer a requirement for claiming the right to substitute child support, but in such cases, the Fund will invite the obligated parent to respond to the claim.);
  • Children over the age of 18 must also submit a valid certificate of school enrollment;
  • Other supporting documents relevant to the entitlement may also be submitted;
  • The Fund is also the central authority for receiving and forwarding international child support recovery requests. You can find more information via the link on international child support recovery.

IMPORTANT!  Claiming the Right for Children Over 18

  • For children over the age of 18 who were already receiving substitute maintenance at the time they became adults, the Fund will automatically review their continued eligibility and invite them to participate in the process.
