Recovery in the Field of Scholarships and Human Resource Development

In the area of scholarships and investment in human resource development, the Fund actively conducts all debt recovery procedures, both out of court and through legal proceedings. Debtors are actively and regularly monitored to ensure prompt repayment of outstanding receivables.

The Fund continuously monitors whether scholarship recipients meet the conditions specified in the scholarship award decision or contract. In the event of non-compliance, the Fund issues a Debt Notice or a Request for Repayment of the Scholarship. In the case of a breach of contract under a programme co-financed by European Cohesion Policy (ECP) funds, the Fund issues a Request for Repayment along with a Contract Termination Notice.

These documents serve as the basis for initiating debt recovery procedures and for the financial monitoring of receivables related to paid scholarships or programmes funded by ECP resources.

Under Articles 99, 101, and 103 of the Scholarship Act, the Fund may allow debtors to repay the debt in instalments or defer payment for a period equal to or shorter than the duration of scholarship payments. This is applicable if the scholarship recipient cannot repay the full amount at once due to justified reasons, or if instalment repayment significantly increases the likelihood of recovering the scholarship, especially in cases where full recovery would otherwise not be feasible. In such cases, the recipient is obligated to repay not only the principal amount but also the revalorized value of the principal, calculated from the date the Debt Notice is issued until the full repayment deadline or, in the case of early repayment, until the actual date of payment.

If the debt is not repaid within the specified timeframes during out-of-court proceedings, the Fund initiates judicial recovery or enforces collection through tax authorities.

In cases where debtors are subject to compulsory settlement or bankruptcy proceedings, the Fund must await the conclusion of the insolvency process. After this process, the Fund’s claim may be repaid in full, partially, or not at all. In such instances, the claim is either partially or fully written off due to the closure of the insolvency procedure.
