Eligible Beneficiaries

The following individuals are entitled to payment:

  • Workers whose employment has been terminated due to bankruptcy, compulsory settlement, or insolvency proceedings of the employer, or who lost their jobs due to the employer being removed from the court register without liquidation, in accordance with the Financial Operations, Insolvency Proceedings, and Compulsory Dissolution Act;
  • Workers who, under an employment contract, performed (or ordinarily performed) work in the territory of the Republic of Slovenia, even if their employer is based in another EU or European Economic Area (EEA) member state.

Conditions for Eligibility:

  • In the case of bankruptcy, workers must have filed their claims within the deadlines and in the manner prescribed by the Financial Operations, Insolvency Proceedings, and Compulsory Dissolution Act;
  • In the case of compulsory settlement, workers must have asserted the protection of their rights within the time limits and according to the procedures set out in the regulations governing employment relationships.

A worker is not entitled to rights arising from the employer’s insolvency if they, alone or together with family members, are the majority owner of the employer’s company or business and exert dominant influence over its operations.
Family members include the worker’s spouse or common-law partner, children, adopted children, children of the spouse or partner, and the worker’s or partner’s parents or adoptive parents, as defined by regulations governing marriage and family relationships, as well as a same-sex partner living with the worker in a registered partnership.

An employer is considered insolvent if:

  • Bankruptcy proceedings have been initiated against them;
  • A decision approving compulsory settlement has become final;
  • Insolvency proceedings have been initiated in another EU or EEA member state where the employer is based.

The beneficiary acquires these rights on the date their employment relationship ends and may receive compensation of up to four and a half times the minimum wage.

Rights arising from an employer’s insolvency are non-transferable personal property rights and cannot be assigned to others or inherited.
