Rights
Types of rights that workers or other eligible beneficiaries may claim from the Fund:
- Unpaid wages or unpaid wage compensation for paid absences from work during the three-month period preceding the date of termination of employment – up to a maximum of three minimum wages;
- Wage compensation for unused annual leave to which the worker is entitled in the current calendar year – up to a maximum of half the minimum wage; and
- Severance pay in the amount and under the conditions applicable to redundant workers, as defined by the regulations governing employment relationships – up to a maximum of one minimum wage.
The basis for calculating these rights is the minimum wage as defined by law on the date the decision is issued. The Fund also calculates and deducts applicable taxes and social contributions from the gross amount before making the final payment to the beneficiary.
These rights may only be exercised upon the beneficiary’s request!
